Dallas County District Attorney’s Office Exonerates Man After Conviction 40 Years Ago

DALLAS (WBAP/KLIF News ) – The Dallas County District Attorneys office has exonerated a man convicted 40 years ago of burglary and child sex abuse charges.

75-year-old Mallory Vernon Nicholson spent 55 years in prison after being convicted in September 1982 and was released on parole in June 2003. He had to register as a sex offender.

At the time of his conviction, he was a 35-year-old father with two children.

Dallas County DA John Cruezot said his office’s Conviction Integrity Unit and the Innocence Project reviewed his case and found prosecutors failed to disclose the victims had identified another suspect.

“After exhaustive re-investigation by the DA Office’s Conviction Integrity Unit it has been determined that Mr. Nicholson is, in fact, innocent.

Before the hearing, Mallory told our media partner WFAA TV it was a harrowing experience.

“It was a pretty devastating ordeal but I put it in God’s hands and I did it one day at a time hoping that this day would finally arrive so I am thankful God,” he said.

After the hearing, Judge Chika Anyiam apologized to Mallory on behalf of everyone who played a role in his conviction and imprisonment.
